The High Court, Commercial Division, presided over by Her Ladyship Justice Akua Sarpomaa Amoah, dismissed Black Sherif’s application for an injunction to prevent him from performing his songs (Mrs).
On April 11, 2022, Shadrack Agyei Owusu filed a case against the artiste, claiming damages and more than GHC 1 million for breach of contract.
He also sought an injunction to prevent the musician from performing or exploiting his talent until the case was tried and a decision was reached.
Mr. Agyei Owusu also requested interim preservation and the appointment of a receiver to manage and account for proceeds from Black Sherif’s music performances and streams.
His attorneys argued that if this was not done, the artist would spend the money.
However, after filing a defense and counterclaim for Black Sherif, the artiste’s lawyers, led by Samson Lardy Anyenini, argued against the motion.
The judge ruled today that Plaintiff had failed to make a strong case for the injunction and related orders he seeks from the court.
If the motion is granted, Defendant will suffer grave injustice, according to Justice Sarpomaa Amoah.
According to the court, there was evidence that Black Sherif was no longer bound by the contract after terminating it, which was not challenged.
Mr. Anyenini thanked the court and stated that he was waiving costs against the Plaintiff because it would not help the parties’ ongoing negotiations to resolve the matter amicably.
