The Nigerian rapper Davido has reached an agreement to resolve his breach of contract lawsuit outside of court with the event organizers, Brownhill Event.
After the “Unavailable” hitmaker signed necessary papers and received payment but did not show up for the annual Warri Again performance, the event organizers, spearheaded by former President of the Nigeria Football Federation (NFF), Amaju Pinnick, filed a lawsuit against him.
The artist will also play at the 2024 Warri Again concert in Warri, Delta State, which is scheduled for October 4. As compensation for Davido’s performance at the event, the parties decided that $94,500 would be given to him for the previous show.
According to the settlement, “the claimant shall provide a private jet to convey the defendants, as well as provide accommodation and other logistics for the defendants performance at the Warri Again concert slated to be held on October 4, 2024,” among other things.
Following their adoption, “these terms of settlement shall be binding upon the parties to this suit, their agents, privies, successors in title, or any person or entity howsoever described acting at the behest or authority of any of the parties to this suit,” the settlement agreement continues.
Background
Davido was sued in November 2023 for defamation and breach of contract by Brownhill Event and its CEO, Amaju Pinnick.
The group said that the musician had let them down in the “Warri Again” events of 2014 and 2019 by canceling his performance after being paid for the dates. He had to make good on the cash he had received for the two events.
Mr. Pinnick stated that Davido’s services were only hired by his organization after the artist contacted him to express interest in taking part in the 19th edition.
According to a Premium Times investigation, on March 30, 2023, Davido’s firm signed a performance agreement with Mr. Pinnick’s BrownHill Event Inc., committing the musician to a performance on October 6 in Warri.
Soso Soberekon, the musician’s representative, signed the agreement, which said that the singer would play for at least “55 or 60 minutes at the event.” The deal was approved by Victor Wokocha on behalf of Brownhill, and a certain Cecil Bekederemo signed as a witness.
The 30-year-old performer, however, was unable to attend the Warri event since he had another engagement scheduled for that same day, October 6, in Melbourne, Australia.
Following his absence from the Warri gig, Mr. Pinnick apologized to the spectators and told them that, despite having fulfilled all of his contractual duties and made the necessary payments to ensure the artist’s participation, he had still failed to show up.
However, Mr. Pinnick claimed that Davido addressed the matter by making derogatory remarks about him on social media in October, including criticizing him for his job as president of the Nigeria Football Federation (NFF). He consequently sued Davido for defamation and breach of contract for two billion naira.
“All issues regarding Warri Again 2023 Concert have been settled between Mr. Amaju Pinnick and myself, and I am happy to announce that I shall be performing live at the Warri Again 2024 Concert on October 4th, 2024 in Warri, Delta State,” is the text that Davido must use to notify his fans on all social media platforms about the amicable resolution.
